U.S. District Judge James Munley, a TRUE AMERICAN HERO

ALLENTOWN, Pa. — A federal judge today struck down the city of Hazleton’s tough anti-immigration law, ruling unconstitutional a measure that has been copied around the country.

The city’s Illegal Immigration Relief Act sought to impose fines on landlords who rent to illegal immigrants and deny business permits to companies that give them jobs. Another measure would have required tenants to register with City Hall and pay for a rental permit.

U.S. District Judge James Munley voided the law today based on testimony from a nine-day trial held in March.

The city will almost certainly appeal.


Hazleton’s Republican mayor pushed for the strict laws last summer after two illegal immigrants were charged in a fatal shooting. Mayor Lou Barletta argued that illegal immigrants brought drugs, crime and gangs to the city of more than 30,000, overwhelming police and schools.

Immigrant groups sued, saying the laws usurp the federal government’s exclusive power to regulate immigration, deprive residents of their constitutional rights to equal protection, and violate state and federal housing law.

In a 206-page opinion, Munley said the act was pre-empted by federal law and would violate due process rights.

“Whatever frustrations … the city of Hazleton may feel about the current state of federal immigration enforcement, the nature of the political system in the United States prohibits the city from enacting ordinances that disrupt a carefully drawn federal statutory scheme,” Munley wrote.

“Even if federal law did not conflict with Hazleton’s measures, the city could not enact an ordinance that violates rights the Constitution guarantees to every person in the United States, whether legal resident or not,” he added.

Hispanic immigrants began settling in Hazleton in large numbers several years ago, lured from New York, Philadelphia and other cities by cheap housing, low crime and the availability of work in nearby factories and farms.

The city, 80 miles northwest of Philadelphia, estimates its population increased by more than 10,000 between 2000 and 2006. Testimony during the trial put the number of illegal immigrants at between 1,500 and 3,400.

Hazleton’s act was copied by dozens of municipalities around the nation that believe the federal government hasn’t done enough to stop illegal immigration. Munley’s ruling does not affect those measures.

Michael, I read the wiki article about Operation Wetback. That occurred in another age, 53 years ago. What succeeded then cannot happen now. That was in the era of Jim Crow. Segregation was being fought over. Then it was the blacks who bore the blunt of America's racist undertones, now, 53 years later, it's the hispanics. I grew up in Arkansas during that era. J William Fulbright (mentioned in the wiki) who was our Senator, Wilbur Mills, Orville Faubus and Jim Johnson, the "Old Guard" as they were called. I don't want to see a return to anything resembling that era. Sadly, that is the way this country is going.

BoWowBoy, I suggest you take a break from reading your right wing extremist websites and take a moment to read the decision written by Judge Munley. It wasn't a really bad call as you say, but the decision was based on BLACK LETTER LAW, spelled out in it's entirety in the U.S. Constitution, the so called "Patriot Movement" holds so dear. Another way to put that, is the basis for the decision is chiseled in stone, it is inviolate. If you will take the time to read the decision (which is available here in the download section), you will also notice that Judge Munley, invalidated and tossed several of the Plaintiffs claims, all based on Constitutional precedence. It might interest you to know that the majority of the plaintiffs were also legal citizens of the United States of Hispanic origin. And as you read the entire 206 page decision, as it is revealed what hasn't been revealed in the anti immigration reporting, about the hate and the racism exhibited against anyone of hispanic origin in Hazelton, ask yourself, if this is what America is really about.

We will get rid of these judges who do not follow the law and legislate from the bench. Americans can and will protect our sovereignty from the invaders. Illegal aliens entering illegally across the borders of the United States of America, is every citizens problem and the fight will take place in the cities and towns across our country. The outcry of the American people as they become more aware of the problem is send them all back to the countries of their origin.

Perhaps you're right Mike and if that is the case, then it is up to Congress to empower the States and Municipalities to do so in order to survive these court challenges. Better, yet, perhaps it's time to put prejudices, bigotry and xenophobia aside and seek a real solution that will bring the illegals out of the shadows so we know who is here. People need to forget the word "Amnesty" and accept the fact that from a practical and logical point of view, it is impossible to round up and deport the estimated 12 million illegals in the country. And Congress needs to get it through their thick ass skulls that the majority of Mexicans DO NOT WANT citizenship. Let them work a few years and they'll return home and stay. Of course they will be replaced by a new bunch, but they too will eventually return home. It's been that way for almost 70 years.

Our federal government isn't doing the job so I believe it is up to the states and municipalities to step in and protect themselves when the feds won't. More power to Hazleton!!!!

The Constitution makes no distinction regarding legal or illegal because when the Constitution was written, the issue did not exist. Now it is your right (one of the guarantees of the Constitution) to be an evil conservative. I happen to be a "thinking conservative" or a "practical conservative". But if you are one of the mainline conservatives, then your belief is that the Constitution of the United States is not a living thing, but rock solid. And therefore should be adhered to, meaning the Bill of Rights applies to all human beings within our borders. There is no reason to hate a group of people because of status and especially a group of people that have no impact on your day to day life. That is stupidity. No Mr, Bush, you can build your fence, but who is going to guard it. And if there are enough people to guard the fence, then you don't need a fence in the first place <quote>But as much fear as there is for the next terrorist attack, there is also an undeniable fear that America is changing. And it appears that only one racial or ethnic group is being blamed for this alteration.</quote> It is hard not to be sensitive to the repeated suggestion that Hispanic immigrants are somehow at fault for the inability of local, state and federal governments to show fiscal restraint, to control crime and to preserve “American” values.

I do not discriminate against any particular illegal in our country. I believe they all should be deported no matter where they have come from. Yes...I am an evil conservative and hate all illegals equally. By the way, I would be interested to read the part of the Constitution that affords these rights to someone who is in the United States illegally. The U.S. Constitution and the Bill of Rights protects all persons within the boundaries of this country, irregardless of race, creed, color, religion or immigration status. Like it or not, it has been this way for 231 years. The judge ruled on the constitutionality of the city circumventing federal authority and nothing more In that manner, he was correct. I think it is time to forget about the Mexicans and concentrate on the illegals in this country who can really do us harm and probably would, given the chance. The middle easterners, the Arabs, Iranians and Iraqis who are hiding out in plain sight in our society. The Mexicans, they come, they work, they go home, an endless cycle.
