The Rule of Law – But only as it applies to your ideology

Ruben Garcia, director of Annuniciation House, listened to a question posed during a conference to respond to a judge's ruling which found the U.S Border Patrol not liable in the 2003 shooting death of Juan Patricio Peraza, a 19-year-old undocumented Mexican immigrant. Peraza is pictured with an unidentified child at right
The United States Fifth Circuit Court of Appeals handed down it’s ruling yesterday in the case of Ignacio Ramos and Jose Compean and Justice was affirmed. US Judge Katherine Carbone was foud to have run a fair trial and the verdict hinged on who the Jury or 12 chose to believe. The Prosecution or the Defense. They chose the former.
Reaction to the ruling is about what one would suspect. but with a few surprises.
WND seemed to get the jump on everyone, not surprising since Jerome Corsi has been instrumental in having this case tried in the Court of Public Opinion, but a couple of hours after we broke the news here, WND relegated the story midways down their page. I guess since the ruling didn’t go their way, it didn’t have much importance to them.
I was surprised that this story was not picked up more quickly once the ruling was released. It was late afternoon before it began appearing, and so far, I have yet to see it on Te Drudge Report Perhaps I missed it.
The Ramos-Compean Blog has still made no mention of it. That is strange. HAsn’t been updated since April.
Looking further around the internet, and you don’t want to do that when you’re hungry, I found the site advertising Free Nachos Hey cool! But it was only another sob site soliciting money.
Appeal Denied – Send Money – 300 donors will restore Nachos monthly salary.
My question here would be, why should the American Public, support a federal felon who has no one but himself to blame for where he is? And $6000 a month? That is a Border Patrol Agents salary? I doubt it.
Looking at the comments being left to this story on Texas newspaper websites, it is disgusting to see the many stupid people that actually believe the garbage they write. And I say stupid, because when they explain the “facts” of the case as they “know” them, they are nothing near the truth of what really happened.
I see and hear how this is a “travesty”, how these people show be immediately freed, awarded Medals, Federal Holidays made for them. Reparations in the amount of $5 million dollars for each of them. Utter trash and garbage from stupid people.
You go to the loony sites such as Willy Gheen’s ALIPAC.us which seems to have a problem with compliance with Federal Codes and they are urging their trolls, er, activists to bombard the 5th Circuit with phone calls and letters demanding they reverse the ruling. Last time I looked, a US Court of Appeals was in place to review cases to make certain all rules of jurisprudence were followed, as was the case here. But unfortunately, for the right wing loons, the Rule of Law only applies when it works in their favor.
I don’t think this is what the Founding Fathers had in mind, not the authors of the Magna Carta, which has been the basis for English common law for more than 700 years.
Interestingly enough, another sotry involving a Border Patrol shooting in El Paso in 2003 is in the news today.
A Judge ruled in El Paso in favor of a Border Patrol Agent who shot and killed a teen wielding a stell pipe. Personally, I think with the array of non lethal weapons available, this was a little extreme, but the Judge has ruled.
What was the difference here? Border Patrol agent Vernon Billings followed the rules! HE reported the shooting and followed all established procedures and today is continuing his job with CBP
Federal Judge Richard Mesa determined that Peraza had ample opportunity to surrender and that Billings, who believed he was in danger, was justified in using deadly force.
Unlike the Ramos and Compean fiasco, where the silent blue line had to be given Proffer Letters in exchange for their testimony of what really happened that day in Fabens,
The Judge found the Border Patrol agents at the scene more reliable than two lay witnesses when they had the opportunity to talk about the shooting before Bil lings gave his statement to the police.
Remember, this is Johnny Suttons jurisdiction. A very pro-law enforcement community.
There was further comment from a spokesman for the Border Patrol.
Jose Romero, a spokes man for the Border Patrol in El Paso, said “the decision speaks for itself.”
Romero said the Border Patrol believes in the integrity of the judicial system and respects the court’s decision.
TJ Bonner, mouthpiece for National Border Patrol Council a group continually in denial of the facts of this case, seems to hold a different opinion than the Border Patrol he represents.
he National Border Patrol Council is extremely disappointed that the United States Court of Appeals for the Fifth Circuit upheld seven of the twelve charges against Border Patrol Agents Ignacio Ramos and José Compean,……………….
The Council firmly believes that both of these agents are innocent of all charges, and remains committed to doing everything in its power to ensure that justice eventually prevails in this case.
You see people. Bonner still don’t get it. First, it is not Border Patrol Agents Ignacio Ramos and José Compean, they are former agents, and now convicted felons, for dishonoring the badge. And Justice has prevailed for a change as evidenced by the ruling of the 5th Circuit.
Judge Masa however, was not critical of the Border Patrols investigations.
In his ruling, Mesa criticized the Border Patrol and stated that “the shortcomings of the investigation are not inconsequential and do not create confidence in BP (Border Patrol) management’s policy decisions … .”
“In short, the failure to investigate properly did not cause Peraza’s death and does not rise to the level of misconduct that would cause the court to alter its credibility determinations.”
So I guess this means the rule of law applies only when it is convenient to your point of view, the narrow minded point of view of hate and racial discrimination.
