It was no surprise when FMCSA Administrator John Hill extended the Mexican Cross Border Program for another two years, thus beating the opposition at their own game.
You see, FMCSA has been calling it a “demonstration program” while the opposition called it a “pilot program” which operates under different requirements, requirements that FMCSA has met.
So John Hill, using the oppositions definition of the program, extends it to 3 years as is permitted for a “pilot program”, and Jimmy Hoffa is furious!

What is Jimmy “mad as hell about? That all the money that has found it’s way into the hip pockets of his politicians hasn’t yielded the intended results? Maybe.
I think Jimmy is further pissed because Mexican law forbids him and his union from organizing in that country. Canada allows it and we don’t hear any objections from him about Canadian trucks.
Osvalso Aldrete-Davilla sentenced to 9 1/2 years in federal prison
EL PASO – Osvaldo Aldrete Davila was sentenced to 9 1/2 years Wednesday for smuggling more than 100 kilos of marijuana in 2005.
U.S. District Judge Kathleen Cardone sentenced Aldrete-Davila of Ciudad Juarez as a result of his guilty plea in the 2005 incident
Jusdge Cardone ironically, was the Judge who presided at the trial of Ignacio Ramos and Jose Compean in 2006.
Ramos and Compeans 11 and 12 year sentence was upheld last week by the US 5th Circuit Court of Appeals which vacated part of the sentence but affirmed the major charges against the two.
OF course the right wing looney toons are whining about the sentence being shorter than that of Ramos and Compean, but they were convicted of using a firearm in the commission of a crime of violence. Aldrete-Davila did not possess nor use a firearm, thus the disparity in the sentences.
Finally, Justice is served for all parties concerned.
EL PASO — Immigration and Customs Enforcement special agents arrested a San Elizario, Texas man on Thursday after he was indicted on sex tourism charges, authorities said.
A federal grand jury indicted Gustavo Solis-Martinez, 35, on July 16 for allegedly traveling out of the country with the intent of engaging in illicit sexual conduct with a teenage girl in Juárez, a federal offense under the PROTECT Act.
PROTECT, which stands for Prosecutorial Remedies and Other Tools to end the Exploitation of Children Today, was signed into law in 2003.
“Sex tourism is a federal offense that ICE investigates aggressively with the assistance of our international law enforcement partners,” said Roberto G. Medina, special agent in charge of the ICE Office of Investigations in El Paso. “This case exemplifies the level of international resolve to ensure that those who prey on children do not go unpunished.”
World Net Daily is reporting that Judicial Watch a so called “watchdog” group has filed suit against the US Government in an attempt to obtain details on the immunity agreement given Osvaldo Aldrete-Davilla for his testimony against ex Border Patrol Agents and convicted felons Ignacio Ramos and Jose Compean who without provocation, shot him in the ass while he was attempting to flee back to Mexico.
How can we forget February 17, 2005 when Jose Compean, on Patrol in the Fabens area spotted a grey van being driven suspiciously by Aldrete-Davilla and the pursuit began that ended at the Rio Grande separating the US from Mexico. Aldrete-Davilla abandoned the van, later found to contain 750 pounds of pot and hot footed it towards Mexico. Encountering Compean on the levee, his last obstacle before the freedom of Mexico, he ducked as Compean tried to take him down with the butt of his shotgun. Compean lost his balance and fell on his face and came back up trying to shoot Aldrete-Davilla in the back. 15 rounds were expended and none found it’s mark. Ignacio Ramos coming to the aid of Compean who he thought was under attack, took one shot that hit Aldrete-Davilla in the ass, and causing immense internal damage. Instead of going to the downed suspect and rendering aid, and arresting Aldrete-Davilla,they turned around and made their way back to their cruisers where other Border Patrol agents had arrived and were searching the abandoned van. At that point, it was discovered that Aldrete-Davilla was a runner. Compean retrieved his brass and chose not to report the shooting to his supervisors as required. Read more
Senator Byron Lesly Dorgan, jumping at the command of Teamsters President Jimmy Hoffa, offered an amendment to the 2009 Transportation Appropriations Bill aimed at shutting down the successful Mexican Cross Border Demonstration Truck Program.
Of course, Hoffa and OOIDA are praising the efforts, but the effort at what?
The current Cross Border Program is slated to end on September 11, This amendment would not take effect until October 1 at the earliest. But it still must go to conference and be reconciled with the HOuse version of the appropriations bill, voted on by the House and the full Senate and sent to the President for his signature. It was growing dark as two women, Ana Maria Arredondo and Idalia Mejía, walked by a house lined with shrubs, when the wannabe adonis, Ciro Guadalupe Hernandez Garci’a, 36, jumped out of the bushes and proudly displayed his package to the two shocked and embarrassed women.
They shouted for help and was soon joined by a relative who chased Garcia into his nearby home.
Municipal Police were notified and Garcia was taken into custody without incident.
Can you imagine how popular he was in the city jail, wearing only a T-shirt and a towel? I imagine the cell bosses thought it was Christmas in June.

This breaking news concerning the 9th Circuit, which has before it, the frivolous lawsuit filed by OOIDA, The Teamsters, The Sierra Club and others, over the Cross Border Program. Perhaps this is the reason OOIDA’s Fast Track has not produced a ruling.
LOS ANGELES – The chief judge of the 9th U.S. Circuit Court of Appeals posted sexually explicit photos and videos on a Web site he maintained that he has now blocked to the public, the Los Angeles Times reported Wednesday on its Web site.
The revelation about Judge Alex Kozinski came as opening statements were under way in an obscenity trial he is presiding over in U.S. District Court in Los Angeles.
Kozinski, 57, told the Times that he thought the material on his Web site, which included a video of a man cavorting with a sexually aroused farm animal, couldn’t be seen by the public. He took the site down and said he didn’t believe any of the images were obscene.
“Is it prurient? I don’t know what to tell you,” he told the newspaper. “I think it’s odd and interesting. It’s part of life.”
Kozinski became the youngest federal appeals court judge in the nation when he was appointed at age 35 to the bench by former President Ronald Reagan in 1985. He is known as a strong defender of free speech and First Amendment rights.
He is currently overseeing a trial in which Los Angeles businessman Ira Isaacs is accused of breaking U.S. obscenity laws by selling pornographic movies that depict extreme fetishes. Kozinski was assigned to the case under a program in which appellate judges occasionally handle criminal trials at the district court level.
Isaacs’ defense attorney Roger Diamond said outside of court he was unaware of the Times report and declined to comment. A phone message left with a spokesman for the 9th Circuit was not immediately returned. Department of Justice spokeswoman Laura Sweeney declined comment.
Before the site was taken down, visitors to alex.kozinski.com saw a message: “Ain’t nothin’ here. Y’all best be movin’ on, compadre.” Visitors who knew about a subdirectory could see the materials that also included some of Kozinski’s legal writings and personal photos, the Times said.
Jean Rosenbluth, a former federal prosecutor and law professor at University of Southern California, said she had not seen the contents on Kozinski’s Web site but added the judge should recuse himself to ensure there is no conflict of interest.
“He should do the right thing and step down,” Rosenbluth said. “There’s such an importance that the public perceive justice be fairly administered.
Trial jurors were scheduled to travel Wednesday afternoon to the 9th Circuit’s Southern California building in suburban Pasadena to view the movies, which depict bestiality and fetishes involving feces and urine. The panel includes eight men and six women. Two will be designated alternates later in the trial.
Jurors will be asked to decide whether or not the films are obscene under federal law.
They must decide if the films appeal to a loathsome or degrading type of sexual intercourse and whether the sexual conduct is “patently offensive,” judging by the community’s standards.
Isaacs, 57, is charged with four counts, including importation or transportation of obscene material for sale. He faces a maximum of 20 years in prison. Prosecutors also are seeking forfeiture of assets obtained through his video sales. Two of the original six counts in his indictment were dropped.
A day after a fatal highway drag racing crash, a pair of local television live trucks were caught on video in their own race at a local drag strip.
The El Paso stations, KDBC-TV and KVIA-TV, were at the legal drag racing strip Friday night when a crowd of onlookers apparently convinced a pair of photographers and a part-time anchorman to race.
Charlie Bernal, a 25-year-old photographer for KDBC, said he was fired Tuesday after his bosses saw the race on the video sharing Web site YouTube.
“I knew what I was doing and figured, if someone gets wind of this I’m in a world of crap,” Bernal said. He added that he didn’t regret his decision to race the station’s only live truck but wouldn’t do it again. KDBC general manager Bram Watkins declined to comment on the incident.
Kevin Lovell, KVIA’s general manager, said photographer Richie Zamora and part-time anchor Rick Cabrera were preparing a story about the legal drag racing site when they made an “impromptu decision” to race the competing station’s vehicle.
“They had the crowd gathered, giggling,” Lovell said. “It was a stupid thing to do. They weren’t thinking.”
Lovell said Cabrera, who was set to take over as a full-time anchor in May when longtime broadcaster Gary Warner retires, and Zamora are likely to face disciplinary action but won’t be fired. “There will be no terminations at KVIA,” Lovell said.
Cabrera said Wednesday he regretted the incident and should have used his position to halt the race.
“I made a big mistake and I take full responsibility for my actions,” Cabrera said. “In hindsight, I can certainly see the error of our ways.”
A video of the race, posted on YouTube, shows the trucks inching to the starting line as a crowd of onlookers cheers them on. As the trucks start racing, one man not seen on the video can be heard commenting that “every cell phone is out” filming the race.
