Francisco Javier Dominguez Rivera - Victim of Border Patrol Murderer Nicholas CorbettDespite overwhelming evidence pointing to the guilt of Border Patrol Agent Nicholas Corbet in the murder of Francisco Javier Dominguez Rivera, U.S. District Judge David C. Bury declared a mistrial at 1345 today.

The prosecution has not indicated whether it will try a third time.

In the meantime, this embarrassment to Federal law enforcement is free to take the law into his own hands as he sees fit!

With the evidence presented, I continue to ask myself, if this had happened on the northern border, would the results have been the same? I think not!

Perhaps any subsequent trials should include a change of venue, perhaps to El Paso Federal Court.

It goes to show how little value people put on human life, especially that of a young Mexican

What I find interesting is that while the defense was whining about the Mexican consul supposedly sitting in the courtroom during the preliminary hearing and signaling answers to the witness, which by the way, was discounted by the presiding Justice of the Peace in that hearing,

Throughout the two week trial uniformed Border Patrol agents and members of the Phoenix Law Enforcement Association sat in the front row of the audience shaking their heads and making other gestures in response to the prosecution’s presentations. Something stinks here!

Reports are coming out from the defense that the deadlock was 11-1 in favor of acquittal. Under the circumstances, and without confirmation from the prosecution, and considering the Jury’s note to the Judge was and remained sealed, I wouldn’t put much credence to that report.

Additionally, the Defense is reporting the Prosecution has indicated there will not be a third trial. The Prosecution has not made this decision.

Border Patrol Agents and their supporters are celebrating this as a victory and vindication of Corbett, which it is not! The head of Corbett’s union is claiming this was textbook police work, which it was not! I know of no training given to law enforcement officers which says they are allowed to shoot an unarmed suspect who is on his knees surrendering as ordered, in the back. That is the actions of a coward! There is nothing to be proud of for those actions.

Again, the State prosecutors need to forget about trying to convict for murder and the US Attorney should consider Federal Civil Rights charges against this moron. He does not deserve to wear a badge!

    Surely it is not a coincidence that this took place in Judge Bury’s courtroom?

    That detail aside — what a tragedy, and what a travesty. I agree with you, open court is open court. We don’t have secret trials.

    How many pieces of the Constitution can they find to bend?
