Murder in the Desert – More thoughts about the trial of Nicholas Corbett

How do you defend a Border Patrol Agent where the evidence suggests the person is guilty? In the case of Border Patrol Agent Nicholas Corbett, you call the witnesses LIARS! And why would you call the witnesses liars? Because they’re Mexican’s of course!
Not proper courtroom procedure but that seems to be the case here.
Last week, lead special prosecutor Grant Woods told the jury that Corbett’s story did not match the evidence from the scene. Meanwhile, he added, the eyewitnesses made statements that were consistent with the autopsy, ballistics and forensics. Keep in mind, it took Corbett several instances to come up with a story he thought would pass muster. It doesn’t.
With forensic evidence against you, testimony of eyewitnesses contradicting your tale of self defense Sean Chapman, the lead defense attorney, did what could be expected. He told jurors the three eyewitnesses are “liars.” I guess because they are Mexican’s, their word means nothing.
Chapman also alleged the Cochise County Sheriff’s Office’s investigation of the incident is “rotten to the core.
You see, Corbett couldn’t get his story straight from the get go! Corbett told some Border Patrol officials that Dominguez-Rivera had picked up a rock and tried to throw it, so he shot him, and he told another agent that the victim shadowed him and he used the Border Patrol vehicle as a shield and then shot him. Forensic evidence show the victim was shot from a distance of 3 to 12 inches, from the back!
During his first trial earlier this year, Corbett testified he was involved in hand-to-hand combat with Dominguez-Rivera and, fearing his head would be smashed with a large rock, he shot him. Corbett simply cannot get his story straight.
Corbett is 6 feet 4 inches tall and weighed 240 pounds, while Dominguez-Rivera was 5 feet 3 inches tall and weighed 145 pounds. Corbett and myself are the exact same height and weight. It’s daylight when this happened and Corbett feels threatened by a kid a foot shorter and a 100 pounds lighter? Who are we kidding here?
Hopefully, if this trial ends in acquittal or another mistrial, the US Attorney will step in and bring charges against Corbett for violating this kids civil rights. It’s a travesty that Corbett has been allowed to remain on duty all of this time.
